can servers for resturants be sub contractors

can a restaurant have sub contractors as servers instead of employees

Server as in waitstaff? They could be I suppose if the owner wants to hire subcontractor waitstaff but I can think of no reason as to why he/she would want to or why a person would want to subcontract as a waiter/waitress/server.
